Burlington Laboratory, Owner Charged For Submitting Unnecessary Drug Tests

BURLINGTON, Mass. (WBZ NewsRadio) — A Burlington independent clinical laboratory and its owner have been charged in connection with Medicaid fraud after allegedly submitting over $400,000 in false claims of urine drug tests, Attorney General Andrea Joy Campbell announced on Friday.

Solid Diagnostics and its owner, Rita Ausiejus of Acton, were indicted in February, in connection with Medicaid fraud and larceny. The clinical laboratory allegedly submitted claims to the Massachusetts Medicaid program for urine drug tests that were "not appropriately ordered by physicians or other authorized prescribers" and are considered "medically unnecessary residential sobriety monitoring," AG Andrea Campbell said.

"Under state regulations, laboratories may not bill MassHealth for tests performed at sober homes for residential monitoring purposes because such tests are not medically necessary. By fraudulently billing MassHealth and its managed care entities for these tests, the defendants are alleged to have caused over $400,000 in false claims," AG Campbell said in a statement.

The charges against Solid Diagnostics and Ausiejus are a part of Attorney General Campbell's work to address Medicare providers' kickbacks and false claims. The AG's office found several independent clinical laboratories involved in illegal kickbacks in 2022.

Solid Diagnostics and Ausiejus are set to be arraigned in Middlesex Superior Court on March 21. They were indicted on two counts each of Medicaid False Claims, Medicaid Reverse False Claims and Larceny over $1,200.
