Massachusetts Employees Can Still Be Fired Over Marijuana Use

BOSTON (WBZ-AM) — While it is legal to purchase marijuana in Massachusetts — with two dispensaries now open — it is still possible to be fired or face disciplinary action from employers due to marijuana use.

Recreational marijuana use may make it difficult to secure a job if a pre-employment drug test reveals marijuana is present in the applicant’s system, according to the Associated Press.

Some employment law experts said there is anecdotal evidence that companies are re-examining their policies around the private, off-duty use of marijuana by workers.

Cambridge-based attorney Eric LeBlanc said every company should review its employee handbook, according to the Associated Press.
