Essex Man Sues Golf Course For Free Hole-In-One Car

GLOUCESTER, Mass. (WBZ NewsRadio) — Daniel Fialho wants his car. An Essex man is suing a local golf club and a car dealership for allegedly skimping out on his SUV prize after he says he hit a hole-in-one.

Fialho said he has been playing the Caleigh Harrison Scholarship Annual Golf Tournament for the past decade or so, including last August. The suit in Gloucester District Court said one of the prizes in the tournament for hitting a hole-in-one was a brand new 2022 GMC Terrain SUV from Sudbay Chevrolet in Gloucester.

Rockport Golf Club is a nine-hole course, so the eighteen holes the golfers play are split between white tees for holes 1-9, and blue tees between holes 10-18.

The man said he sunk a hole-in-one on one the blue tees on the first try. When he tried to collect the car, his lawyer Kenneth Shea said the car dealership refused to pay up. They claimed the hole-in-one had to be hit from the white tees to count.

"We tried to work it out before filing a lawsuit. It's the last thing Danny Fialho wanted, was to file a lawsuit. But he rightfully won the car, and if that's the only way he's going to get the car, it's what needs to be done," Shea told WBZ NewsRadio.

The suit is asking for the value of the car in damages — $35,000 — and said Fialho he has plenty of witnesses.

WBZ NewsRadio has reached out to the two defendants, Rockport Golf Club and Sudbay Chevrolet, but neither have responded for comment so far.
