Read Prosecution Submits Its Response To SJC Appeal By Defense

BOSTON (WBZ NewsRadio) — The prosecution in the Karen Read murder case that ended in a mistrial has submitted its response to her defense team's appeal to the state's Supreme Judicial Court to dismiss two of the three charges she is facing.

The defense said jurors reached out to them after the mistrial was declared and indicated they were unanimous to acquit her of the second-degree murder charge and leaving the scene but were hung up on the manslaughter charge.

The prosecution's response is asking the SJC to consider the impact Read's appeal could have on future juries.

It says Judge Beverly Cannone followed the proper steps and had the authority to declare a mistrial.

It also argues that all three of the charges should remain intact in Read's upcoming re-trial that begins in January.

Oral arguments in the SJC hearing are Nov. 6.
