Supreme Court Will Hear Marathon Bomber Death Penalty Case In The Fall

BOSTON (WBZ NewsRadio) — The Supreme Court will hear the case for reinstating Boston Marathon bomber Dzhokhar Tsarnaev's death penalty this fall. A schedule released by the court said the oral arguments for the case, United States v. Tsarnaev, will take place on October 13, 2021.

The court decided to hear the case back in March.

Tsarnaev originally received a death sentence for his involvement in the 2013 Boston Marathon bombing, but the 1st Circuit Court of Appeals overturned the sentence last summer, saying the original court that tried Tsarnaev should have been more careful when selecting jurors, who may have been exposed to the media spectacle before Tsarnaev's trial.

Now, the Supreme Court will hear arguments for and against reinstating that death penalty.

Tsarnaev is involved in an ongoing legal battle with the Colorado federal prison where he's being kept, over what he claims are violations of his Constitutional rights there.
