The Battle Between Barstool Sports Versus Somerville Mayor Curtatone

SOMERVILLE, Mass (WBZ NewsRadio) — Mayor Joseph Curtatone sued Barstool Sports after claiming he was tricked into a recorded phone conversation.

Mayor Curtatone was on the phone with Barstool employee Kirk Minihane who was pretending to be Boston Globe columnist Kevin Cullen.

The Massachusetts wiretapping law, the “two-party consent” law, makes it a crime to secretly record a conversation.

However, a number of justices are now sharing their concerns in their oral arguments about whether this trickery violates the letter of the law since Curtatone knew he was being interviewed and recorded—just under the impression that he was speaking to someone else.

The court is set to rule at a later date on the latest oral arguments.
